Abstract |
Background. The interaction between law and economy acquires special relevance in the modern world. Against this background, law science proposes to distinguish an independent branch (a number of scientists have remarked on the emergence of a mega-branch) – economic law. The major aim of the article is to reveal the concept of economic law, its content and place in the system of public law sciences. Based on this aim, the following tasks are set: to present a historical analysis of the doctrine in the relevant area (the pre-revolutionary and Soviet doctrinal sources are studied); to highlight modern understandings of the economic constitution and economic analysis of law comparing them with the concept of economic law; to determine the role of state influence on modern economic relations. Materials and methods. The tasks are solved through scientific analysis of a wide range of sources devoted to the legal impact on economic relations. The comparative legal methods are mainly used to determine the content of the Western legal tradition on the impact of law on the economy (and vice versa). The historical and legal method gives a holistic picture of the Russian scientific doctrine on the topical issues raised. Results. The study indicates that economic law should not be considered as an independent branch of law. Economic law can be perceived as an interdisciplinary training course that incorporates the most pressing issues of interaction between law and economy. Conclusions. The article presents the conclusion, according to which the complication of social relations, the development of integration processes and the change in the economy structure actualize interdisciplinary research based on the intersection of sciences: law, politics, economics. The final transition to the market economy (legally formalized in the Russian Constitution in 1993) led to a particular interest in its doctrinal foundations. This synthesis gave rise to a new branch – economic law. |
